If you choose to purchase an image or images from our archives, you are charged only when the image is downloaded and/or published. The fee is based on your publication profile. Only a registered Publisher/Client can download full resolution images. Please contact us if you wish to obtain iPhoto price list.

Standard Publisher's/Client's Agreement and the Publisher's/Client's Assignment Agreement

This is a legal Agreement between the Publisher/Client and iPhoto Inc. (also referred to as iPhoto.ca or iPhotoLive or iPhoto). Read this Agreement in its entirety before you continue to use this site or download images.

By registering with iPhoto, you agree to the terms and conditions specified in the Standard Publisher's/Client's Agreement and the Publisher's/Client's Assignment Agreement.

The Publisher/Client and iPhoto agree as follows:

* iPhoto images are limited to one-time editorial use only, in a single Publisher's/Client's own publication only. * Any additional use requires additional licensing. * The Publisher/Client may not sell, loan, sublicense, or otherwise transfer any iPhoto image to anyone else. * iPhoto images may not be stored in any database for future use. * iPhoto images may not be altered or manipulated beyond normal image enhancement and cropping.
Moral rights are not waived. * The Publisher/Client may not use any iPhoto image in a way that might be deemed defamatory, fraudulent, libelous, obscene, immoral, pornographic or that violates the subject's right of privacy or publicity. * A mandatory credit line and copyright notice must accompany every image. Credit line shall be in the form of: the Photographer's name/iPhoto * Failure to include complete credit line and copyright will result in 50% surcharge. * iPhoto makes every effort to ensure the accuracy and reliability of the content and services on our site. However, the Publisher/Client acknowledges that iPhoto is not liable for any loss, cost or damage arising out of any inaccuracies, errors or omissions contained in the iPhoto services. * Unless indicated, iPhoto gives no representation or warranties with respect to model or property releases, use of names, trademarks, logos, uniforms, registered or copyrighted designs, or works of art depicted in any image. * The Publisher/Client agrees to indemnify and hold harmless iPhoto and its Directors, Agents and Photographers against any and all claims, liabilities, damages, costs and expenses, including attorney's fees, resulting from any breach of this Agreement by the Publisher/Client. * Should a Publisher/Client violate any requirements or agreements, iPhoto will attempt to obtain appropriate corrections and remedies from the Publisher/Client. In case of repeated violation, iPhoto will cancel the violator's registration without notice. * Use of any image beyond the rights granted in this Agreement constitutes copyright infringement and is punishable to the full extent of the law.

In addition to our Standard Publisher's/Client's Agreement

The Publisher/Client and iPhoto Inc. (also referred to as iPhoto.ca or iPhotoLive ot iPhoto) agree as follows:

* This Agreement will govern all photographs taken by the iPhoto Photographer on an assignment from the Publisher/Client. * At the time of each assignment, iPhoto and the Publisher/Client will mutually agree on the fee and the expenses. iPhoto will be paid no later than thirty(30) days after the assignment is completed and submitted to the Publisher/Client. * The contracted Photographer agrees to give iPhoto and the Publisher/Client exclusive, first-time, one-time print or electronic publication rights. * The photographs resulting from the assignment have at least a ninety(90)-day exclusivity period. * The Photographer shall be paid additionally by the Publisher/Client if any of the assignment related images were used for electronic reproduction, commercial purposes, promotions or advertisements. The Publisher's/Client's obligation is to negotiate in good faith, prior to use of the images. * iPhoto retains copyright ownership of photograph(s). * The Photographer guarantees originality, authorship, authenticity and ownership of all rights in each photograph. * The Photographer guarantees that material has not been previously published. * The Photographer guarantees that publication of photograph(s) will not infringe upon any copyrights, right of privacy, proprietary or any other rights. * Any amendments to this Agreement must be submitted in written form prior to assignment confirmation. * By placing an order for assignment, the Publisher/Client acknowledges that he/she has been informed about the Publisher's/Client's Assignment Agreement and agrees to all its terms and conditions. * By submitting an Assignment Request Form, the Publisher/Client confirms that he/she has read the Publisher's/Client's Assignment Agreement and agrees to all its terms and conditions.
